§ 1. General Provisions
- These terms and conditions (hereinafter referred to as the “Terms and Conditions“) define the rules and conditions for using the online store available at noko.band (hereinafter referred to as the “Store“), including the rules for placing orders, concluding sales contracts, product delivery, payments, and complaint procedures.
- The Seller and owner of the Store is Michał Jan Ciesielski, conducting business activity under the company name Michał Jan Ciesielski Production, with its registered office at ul. Miraua 4/4, 80-318 Gdańsk, NIP: 5851436929, REGON: 529115185 (hereinafter referred to as the “Seller“).
- The Store conducts retail sales to Consumers and Sole Traders with consumer rights (Entrepreneurs with consumer rights). The sales include:
- Physical goods: clothing and accessories (merch), physical music media (CDs, vinyl records, including the album “K.O.”);
- Digital content: music files in digital format (e.g., MP3, WAV, FLAC);
- Tickets: electronic admission tickets entitling the holder to participate in concerts and artistic events organized or co-organized by the Seller.
- The Client can contact the Seller quickly and efficiently via email at: shop@noko.band.
§ 2. Placing and Fulfilling Orders
- The Client may place orders in the Store 24 hours a day, 7 days a week via the order form available on the website noko.band.
- In order to place an order, the Client selects products, adds them to the virtual cart, fills out the delivery and billing information form, and then confirms the order by clicking the button indicating the obligation to pay (e.g., “Buy and Pay”).
- The sales contract between the Client and the Seller is concluded upon successful payment by the Client and receipt of an e-mail confirming that the order has been accepted for processing.
- The order fulfillment time for physical goods (preparation for shipment, packaging, and handing over merch, CDs, or vinyls to the carrier) is up to 5 business days from the date the payment is credited. Delivery time by the selected logistics operator should be added to this period.
- Order fulfillment for digital content and electronic tickets takes place immediately (usually within a few minutes) after payment confirmation, by sending a download link or transmitting the ticket document in PDF format to the e-mail address provided by the Client.
§ 3. Prices, Payments, and Proof of Purchase
- All prices listed in the Store are expressed in Polish Zloty (PLN).
- The Seller declares that it is an entity exempt from Goods and Services Tax (VAT) pursuant to Art. 113 sec. 1 (or sec. 9) of the Polish Value Added Tax Act. Therefore, the prices visible in the Store are final prices (gross in terms of no additional VAT being charged) and do not include VAT.
- The Seller attaches a proof of purchase to each order. At the explicit request of the Client submitted during the ordering process, the Seller issues an invoice (an invoice without VAT).
- The Store supports electronic payments through authorized payment operators (e.g., PayU, Przelewy24, Stripe, BLIK, etc.). The Client is obliged to pay for the order directly during its placement.
- The shipping costs for physical goods are indicated to the Client during the order process and are added to the final amount of the order.
§ 4. Right of Withdrawal (Returns)
- A Client who is a Consumer or a Sole Trader with consumer rights has the right to withdraw from a distance contract within 14 days without giving any reason, subject to the exceptions specified in sec. 3.
- The withdrawal period expires after 14 days from the day on which the Client takes physical possession of the physical goods. To exercise the right of withdrawal, the Client must inform the Seller of their decision by an unequivocal statement (e.g., by sending an email to shop@noko.band) and send the goods back at their own expense.
- According to Art. 38 of the Polish Consumer Rights Act, the right to withdraw from the contract DOES NOT apply to the Client in respect of:
- Concert / Event Tickets: contracts for the provision of services related to entertainment, sports, or cultural events, if the contract specifies the day or period of service provision (Art. 38 point 12 of the Act). Purchased tickets with a designated date are non-refundable.
- Unsealed CDs and Vinyls: contracts where the subject of the service is sound or visual recordings delivered in a sealed package, if the package was opened after delivery (Art. 38 point 9 of the Act). This means that a CD or vinyl record with broken protective shrink-wrap is non-refundable.
- Digital Content (Music Download): contracts for the supply of digital content not delivered on a tangible medium for which the Consumer is liable to pay the price, if the performance has begun with the Consumer’s prior express consent before the expiry of the withdrawal period and after the trader has informed the consumer of the loss of their right of withdrawal (Art. 38 point 13 of the Act).
§ 5. Complaints (Non-conformity of Goods with the Contract)
- The Seller is obliged to deliver products (goods, digital content, tickets) that comply with the contract and are free from defects.
- In the event of non-conformity of the product with the contract, the Client is entitled to the rights specified in the provisions of the Polish Consumer Rights Act (including demanding repair, replacement, price reduction, or withdrawal from the contract).
- Complaints should be submitted electronically to the email address: shop@noko.band. It is recommended to include the order number, a description of the defect, and the complaint request in the submission.
- The Seller will consider the complaint and provide a response within 14 days from the date of its receipt.
§ 6. Final Provisions
- The Terms and Conditions enter into force on the date of their publication on the Store’s website.
- The Seller reserves the right to amend the Terms and Conditions for important reasons (e.g., changes in the law, changes in payment or delivery methods). Contracts concluded before the amendment of the Terms and Conditions shall be governed by the version in force on the date the order was placed.
- In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
